    1. General

    Cardio Plein Air inc (Cardio Plein Air), or their franchisees are entities that will be referred to for the purposes of this Privacy Policy as “Cardio Plein Air. However, for the purposes of applying this Privacy Policy or any applicable law or regulation, said entities shall be independent of each other and each shall not be binding on the other entities. Thus, when this Policy refers to “Cardio Plein Air”, it may mean Cardio Plein Air and/or its affiliates, subsidiaries and franchisees, as well as their respective shareholders, officers, directors, employees, agents, partners, principals, representatives, successors and assigns.

    Cardio Plein Air respects your privacy and values its relationship with you.

    Cardio Plein Air is committed to protecting your Personal Data and your right to privacy. Should we ask you to provide us with Personal Data by means of which you could be identified during our activities, and in particular through this Web site or through our registration platform, we assure you that this data will only be used in accordance with this policy. This privacy protection policy describes the type of Personal Data we collect on the Cardio Plein Air Web site, located at www.Cardio Plein Air.ca (the “Web site”) or in connection with the operation of Cardio Plein Air activities, how we may use this information and with whom we may share it. Our privacy policy also describes the measures we take to protect the security of this information and how you can access, change or delete your Personal Data. If you do not consent to the terms and conditions regarding the collection, use and disclosure of Personal Data set out in this Privacy Policy, please do not use the Web site or register for activities offered by Cardio Plein Air. Please note that this Privacy Policy governs only the collection, use and disclosure of Personal Data collected through the Web site or following your registration through the registration platform. It does not govern any other information or communication that may mention Cardio Plein Air.

    1. Personal Data collected

    You may choose to provide us with Personal Data when you visit the Web site or when you purchase services from Cardio Plein Air or its franchisees or when you register to our registration platform, such as registration or billing for services. For example, you may be asked for information such as your name, date of birth, e-mail address, mailing address, telephone number and company name when you choose to communicate with us through one of the various means offered on the Web site or otherwise. Please do not provide us with any Personal Data from third parties when using the Web site or when requesting services from Cardio Plein Air, without first obtaining their express consent to such communication.

    1. Consent

     

    By providing Personal Data to Cardio Plein Air, its franchisees or component entities, or its service providers and agents, you authorize us to collect, use and disclose such Personal Data in accordance with this Privacy Policy and as authorized or required by law.

    Subject to legal and contractual requirements, you may refuse or withdraw your consent to certain of the identified purposes at any time by contacting Cardio Plein Air’s Privacy Officer. If you refuse or withdraw your consent, Cardio Plein Air may be unable to provide or continue to provide you with certain services or information that may be useful to you. If you provide such information, we will use it to provide you with the services you require.

    1. Limited collection, use and communication

    Cardio Plein Air limits the collection of Personal Data to that which is reasonably necessary for the purposes for which it was collected. Cardio Plein Air collects, uses and communicates your Personal Data solely for the purpose of providing you with the services for which you have registered, including requests concerning Cardio Plein Air products and activities. In this regard, if you have registered for activities, your Personal Data will be communicated to the service providers who will provide the services for which you have registered. Cardio Plein Air shall inform individuals of any additional purposes for which their Personal Data may be used or communicated in the future, prior to such use or communication taking place. Cardio Plein Air may use your Personal Data to communicate to you, from time to time, information regarding its products and the products of its partners, as well as other company news. In accordance with article 6 below, you may unsubscribe from these communications at any time. Personal Data may also be shared internally and with affiliates and related companies of Cardio Plein Air to enable us to respond appropriately to your requests or otherwise assist you, as described above. Cardio Plein Air retains your Personal Data only as long as it is required for the purposes for which it was collected, and deletes or destroys such information once these purposes have been fulfilled and the Personal Data is no longer required.

     

    1. Accuracy of your Personal Data

    To assist you in a professional manner, the Personal Data we collect must be accurate, complete and up to date. You may access, update and correct any inaccuracies in your Personal Data in our custody and control by sending an e-mail to confidentialite@cardiopleinair.ca . If the Personal Data we hold about you is inaccurate or incomplete, you have the right to have it corrected. If you have the right to rectification and we have shared your Personal Data with third parties, we will inform them of the rectification where possible and where this does not require a disproportionate effort. On request, where possible and legal, we will also tell you to whom we have shared your Personal Data, so that you can contact them directly.

     

    1. Withdrawal of consent to collection, use and communication

    You may withdraw your consent to the collection, use and disclosure of your Personal Data at any time by e-mailing us at confidentialite@cardiopleinair.ca. However, if you withdraw your consent, we may not be able to continue to respond to your requests or provide you with the services required in connection with any registration. In addition, we will not otherwise be able to assist you with respect to the Web site. With respect to marketing communications, you may choose whether or not to receive such communications from us. You may change your preferences regarding commercial communications at any time by clicking on the “unsubscribe” link at the end of each commercial promotional e-mail we send you, or by e-mailing us at confidentialite@cardiopleinair.ca and stating that you no longer consent to receive e-mail or direct mail.

     

    1. Personal Data we disclose and to whom we disclose it

    We do not provide your Personal Data to third parties for their use in marketing their products or services to you without your consent. In addition, we do not sell or otherwise disclose Personal Data about Web site visitors or our customers except as described herein. However, while operating our business, we may disclose your Personal Data to our subsidiaries, affiliates, franchisees or subcontractors who provide the activities for which you have registered or who have relationships with our representatives, for their use in accordance with this Privacy Policy.

    Service Providers. We may use other companies and individuals to perform functions on our behalf in a manner consistent with this Privacy Policy, including, but not limited to, data analysis companies, customer support specialists, service providers to perform the required services for which you have registered. We require third-party service providers to respect the confidentiality of Personal Data and all legal requirements under applicable Canadian federal and provincial privacy legislation, and to agree to contractual requirements that are consistent with this Privacy Policy. These third parties may be authorized to access the Personal Data required to perform their duties but may not use this information other than to provide the services required by Cardio Plein Air, in accordance with this privacy protection policy, and solely for the specific purposes for which we have provided it to them.

    1. Respect for the law.

    Each of the entities making up the Cardio Plein Air group, their subsidiaries, related companies, franchisees, and their third-party service providers may disclose your Personal Data in response to a search warrant or other legally valid request or order, or in other cases where required by applicable law. We may also disclose Personal Data when necessary to assert, exercise or defend legal claims, to the extent otherwise permitted by law. Finally, as part of its operations, the companies comprising Cardio Plein Air may share or disclose Personal Data in connection with a merger, acquisition, bankruptcy, dissolution, reorganization, sale of all or part of the assets of any of the companies comprising Cardio Plein Air, its financing, the acquisition of all or part of one of the entities, a transaction or similar proceeding, or steps taken in view of such activities, for example, during a due diligence review.

    1. Security of Personal Data

    Cardio Plein Air protects your Personal Data by security safeguards appropriate to the sensitivity of the information. Personal Data is stored in secure environments that are not accessible to the public.

     

    1. Transfers of Personal Data to other provinces or countries

    In some cases, Personal Data may be processed and stored outside the province of Quebec in Canada or outside Canada by Cardio Plein Air, affiliates or related companies of Cardio Plein Air or a third-party service provider, and such Personal Data may be disclosed in accordance with the laws applicable in the jurisdictions where the information is processed or stored. These laws may not provide the same level of protection as Canadian privacy laws. In such cases, Cardio Plein Air will ensure that such information is protected as described in this Privacy Notice, and we will take steps, if necessary, to ensure that international transfers are carried out in accordance with applicable laws.

    1. Cookies – When a visitor accesses the www.cardiopleinair.ca Web site, we may use a browser feature called a “cookie” to collect information such as the type of Internet browser and operating system used by the visitor, the domain name of the Web site from which the visitor came, the date and duration of the visit, the number of visits, the average time spent on our Web site, the pages viewed and the number of cookies accumulated. A cookie is a small text file containing a unique identification number that identifies the visitor’s browser (but not necessarily the visitor) to our computers each time someone visits our Web site. We do not know the identity of visitors who access our Web site, unless they specifically tell us (e.g., by registering for an event or sending us correspondence from the Web site). In addition to the identified purposes described in our Privacy Policy, we may use this information from the Web site and share it with other organizations with whom we have a business relationship to measure the use of our Web site, improve its functionality and content, and make it easier for visitors to use. However, if they refuse cookies, they may not be able to use some of the features of our Web site.

Online communications – In order to receive a service or information, visitors to our Web site may voluntarily provide us with Personal Data to register for selected services, but also to ask questions, request information, view or download publications, subscribe to newsletters or a mailing list by mail or e-mail, attend a conference or other event, or participate in contests and surveys. If Cardio Plein Air knows you as a registered user of an online service, we may combine and retain Personal Data about your use of our Web site and the online information you have provided us with certain other online and offline information we may have collected.

    1. E-mail communications – From time to time, we may send you marketing or promotional communications by e-mail with information that may be useful to you, including information about the services of one or more of the Cardio Plein Air entities and other third parties with whom we have a business relationship. As part of this process, we may collect certain information such as the date and time you first opened the communications we sent you by e-mail, the number of times you opened them, the number of clicks per item, the total frequency of clicks on the content of these communications, and we may make a general compilation of related statistics. We may combine and store any such information for the purposes of managing and improving the communications we send you by e-mail. We will include instructions on how to unsubscribe and inform us of your preferences if you do not wish to receive future marketing or promotional e-mails from Cardio Plein Air.

     

    1. Links to third-party sites

    Our Web site may contain links to other Web sites that we do not own or operate. Unless otherwise specified herein, we do not share any of your Personal Data with these third parties without your consent. Linked Web sites may contain separate and independent privacy statements, notices, and terms of use that we recommend you read carefully. We have no control over such Web sites and therefore have no responsibility or liability the way the organizations that operate such Web sites may collect, use or disclose, protect and otherwise treat your Personal Data.

     

    1. Retention of Personal Data

    We retain your Personal Data only as long as is necessary to fulfill the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as requirements under tax or accounting laws, or any other legal requirement, including following your registration for services). If we no longer have a legitimate business interest in continuing to process your Personal Data, we will delete, de-identify or anonymize it, or if it is not possible to do so (because, for example, your Personal Data has been stored in backup archives), then we will store your Personal Data securely and ensure that it ceases to be processed until it is possible to delete it.

    1. Updates to our Privacy Policy

      We may revise this Privacy Policy from time to time. If we decide to change our privacy policy, we will post the revised policy here. To ensure that you are aware of our most current privacy terms and conditions, we suggest that you periodically visit this Privacy Policy page.

    1. Liability

    Cardio Plein Air and all its authorized franchisees and service providers are responsible for all Personal Data in its possession or control. We have developed policies and procedures to protect Personal Data. We have taken important steps to ensure that your visit to our Web site or use of our services is successful and that your privacy is respected.     You may withdraw your consent to the use of your Personal Data at any time by submitting a request to that effect to confidentialite@cardiopleinair.ca .

    You may also withdraw or restrict your consent to the use of your Personal Data for marketing purposes in one of the following ways, namely by unsubscribing when you receive an e-mail for marketing purposes from Cardio Plein Air or one of its authorized franchisees or by contacting confidentialite@cardiopleinair.ca .

    If you would like more details about the Personal Data we hold, or if you believe that the Personal Data we hold is incorrect or incomplete, you may also submit a request to confidentialite@cardiopleinair.ca . We will immediately correct any Personal Data found to be inaccurate.
